Welcome to ImgPilot! These Terms of Service ("Terms") apply to your access to and use of the services provided by ImgPilot, an AI image generation platform. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our services.
By creating an account on our service, you agree to receive communications from us, including service notices, transaction receipts, and (where you have opted in) marketing or promotional materials. You may opt out of marketing communications at any time by following the unsubscribe link included in such emails or by contacting us via email.
If you wish to purchase any product or service made available through our service ("Purchase"), you may be asked to provide certain information relevant to your Purchase, including payment card details and your billing information. You represent and warrant that you have the legal right to use any payment method in connection with any Purchase, and that the information you provide to us is true, correct, and complete.
We use Stripe to process payments and facilitate the completion of Purchases. By submitting your payment information, you grant us the right to provide that information to Stripe, subject to our Privacy Policy.
ImgPilot offers certain parts of our service on a subscription basis ("Subscription"). You will be billed in advance on a recurring monthly basis ("Billing Cycle") according to the subscription plan you select. At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or we cancel it.
You may cancel your Subscription renewal at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current Billing Cycle, and you will retain access to your Subscription benefits until then.
A valid payment method is required to process the payment for your Subscription. You must provide ImgPilot with accurate and complete billing information. By submitting such payment information, you authorize ImgPilot to charge all Subscription fees incurred through your account to the payment method you provide. If automatic billing fails for any reason, your Subscription benefits may be suspended until payment is successfully processed.
ImgPilot reserves the right to modify Subscription fees at any time. Any Subscription fee changes will become effective at the end of the then-current Billing Cycle. We will provide reasonable advance notice of any fee change to give you the opportunity to cancel before the change takes effect. Your continued use of the service after a fee change constitutes your agreement to pay the modified fee.
Monthly Subscription plans are eligible for a full refund within 7 days of the initial purchase, provided that fewer than 20 credits from that Subscription have been consumed. Subscription renewals (recurring monthly charges after the initial purchase) are not eligible for this 7-day refund window — to avoid being charged for a renewal, please cancel your Subscription before the current Billing Cycle ends.
One-time credit pack Purchases are eligible for a full refund within 7 days of purchase, provided that none of the credits from that Purchase have been used. Once any portion has been consumed, the credit pack is non-refundable.
Credits granted as promotional bonuses (such as the signup bonus or share rewards) have no cash value and are not refundable. Once used, credits are non-refundable regardless of whether you are satisfied with the generated output, since AI generation results are inherently variable.
If a generation fails due to errors on our side or upstream provider failures, the consumed credits will be automatically refunded to your account — no manual request is required.
To request a refund, contact us at hi@imgpilot.app with your account email, the Stripe transaction ID, and the reason for your request. Approved refunds are issued through Stripe and typically appear in your account within 5–10 business days, depending on your card issuer.
When you create an account with ImgPilot, you guarantee that you are over the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.
You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account, whether your password is with our service or a third-party service (such as Google social login). You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity, or a name that is not lawfully available for use, or offensive, vulgar, or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. You acknowledge that your account is for your personal use only and may not be shared with others. Sharing or allowing unauthorized access to your account is strictly prohibited and may result in suspension or termination of your account.
When using our services, you acknowledge and agree that your usage is subject to adherence to these Terms, all applicable laws and regulations, and the usage policies of the upstream model providers that power our Service.
It is strictly prohibited to engage in any illegal, harmful, or abusive activities while using our services. You are not allowed to:
ImgPilot and its licensors own and retain all rights, title, and interest in and to the service and its original content (excluding content provided by users), features, and functionality. The service is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain ownership of any content, including text prompts, reference images you upload, and images you generate using the Service ("User Content"). You are solely responsible for the User Content you create, upload, publish, or share through the Service.
Subject to your compliance with these Terms, you own the images you generate through the Service ("Outputs") and may use them for personal or commercial purposes. Your use of Outputs is also subject to the usage policies of the upstream model providers that power the corresponding models. Due to the nature of generative models, other users may receive similar or identical Outputs from similar prompts, and we make no guarantee of uniqueness, originality, or copyrightability. You are solely responsible for ensuring that your use of any Output does not infringe the rights of any third party.
By submitting User Content to the Service, you grant ImgPilot a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such User Content for the purpose of operating and improving the Service.
When you choose to use the public sharing feature to share a generated image to social media, you additionally grant us the right to display that content (along with the prompt and model used) on a public landing page accessible to anyone with the link, until you delete the corresponding generation from your history.
You agree not to upload, generate, or share any User Content that:
Any violation of these terms may result in the suspension or termination of your account.
We respect the intellectual property rights of others and have a policy to respond to any claim that content posted on our service infringes on the copyright or other intellectual property rights of any person or entity. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a claim to us at hi@imgpilot.app with the subject line "Copyright Notice", including a description of the work, the URL of the allegedly infringing material, and your contact information. You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims. We may terminate the accounts of users who are deemed to be repeat infringers.
ImgPilot may contain links to third-party websites or services that are not owned or controlled by ImgPilot. ImgPilot has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. ImgPilot does not warrant the offerings of any of these entities or their websites. You acknowledge and agree that ImgPilot shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. We strongly advise you to read the Terms of Service and Privacy Policy of any third-party website or service that you visit.
ImgPilot provides its services on an "as is" and "as available" basis, and makes no representations or warranties of any kind, express or implied, as to the operation of the services, or the information, content, or materials included therein. You expressly agree that your use of the services, their content, and any services or items obtained from ImgPilot is at your sole risk.
Neither ImgPilot nor any person associated with ImgPilot makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. Without limiting the foregoing, neither ImgPilot nor anyone associated with ImgPilot represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes them available are free of viruses or other harmful components, or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.
ImgPilot hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for a particular purpose. The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.
Except as prohibited by law, you will hold ImgPilot and its officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damages, however they arise (including attorneys' fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any laws, statutes, rules, or regulations, even if ImgPilot has been previously advised of the possibility of such damages. Except as prohibited by law, if there is liability found on the part of ImgPilot, it will be limited to the amount paid by you for the products and/or services in the twelve (12) months preceding the event giving rise to the liability.
